The first document you will need is your Original Marriage Certificate. Once you meet the legal requirements for divorce, either spouse may begin the process by attending their local Circuit Court office and submitting the following paperwork:
Family Law Civil Bill.
This is the primary document in your application. It sets out the background and details of your case, giving the court a clear picture of your situation.
Affidavit of Means.
This form provides the court with a clear overview of your financial circumstances. Most Circuit Courts across Ireland request this document, even in situations where there is no disagreement between spouses regarding money matters.
DIy Divorce
Affidavit of Welfare.
This form sets out the current arrangements for the care and upbringing of your children. It is only required in cases where the marriage involves children.
When you bring the necessary documents to your local Circuit Court Office, the court will “issue” the proceedings—this marks the formal beginning of your divorce case.
Your spouse must then be served with the issued documents within specific time limits and in the correct manner. Should your spouse choose to contest the case, they will need to file their own documents within the court’s required deadlines.
If your spouse does not challenge the application and/or gives their consent, you may request a court date for the hearing of your divorce.
All divorce hearings are held in camera, meaning in private. Only the judge, court staff, you, your spouse, and any legal representatives will be present.
